Temporary practice ('fly-in, fly-out' practice)
There is no express rule allowing temporary practice by foreign lawyers.
Limited licensing of foreign lawyers (foreign legal consultant rules)
A foreign lawyer cannot obtain a limited licence entitling them to offer advisory services in foreign and international law (i.e. become a foreign legal consultant).
Full licensing
A foreign lawyer can obtain a full licence to practise law in this jurisdiction.
For purposes of the professional practice in Peru by foreign graduates in law, Peruvian domestic legal framework establishes as a first condition the recognition and validation of degrees issued by foreign universities.
The National Assembly of Rectors recognizes the degrees, diplomas or educational certificates obtained in countries with which Peru has signed International Agreements for the Recognition of Degrees issued by foreign universities. These countries are the following: Argentina, Bulgaria, Bolivia, Colombia, Costa Rica, Cuba, Chile, China, Ecuador, El Salvador, Spain, Guatemala, the Holy See, Honduras, Hungary, Mexico, Nicaragua, Panama, Paraguay, Romania, Russia, Ukraine, Uruguay and Venezuela.
For the recognition and validation of degrees from foreign countries with which Peru has not signed International Agreements for the Recognition of Degrees, these degrees must be validated by one of the universities (21 universities established nationwide) authorized by the National Assembly of Rectors.
In addition to the recognition of the foreign degree, a foreign lawyer who wants to practice in Peru must be incorporated at the Lima Bar Association.
The regulation applicable for the issuance of full licenses is contained in the Statutory Rules of the Lima Bar Association.
Commercial association between lawyers and law firms
In this jurisdiction:
- Local lawyers may be employed by another local lawyer or a local firm.
- Local lawyers may be employed by a foreign lawyer or a foreign firm.
- Foreign lawyers may provide services in some other form of commercial association with local lawyers.
- Foreign firms are permitted to establish a commercial presence (a permanent office) to offer advisory services in foreign and international law.
- Foreign firms are permitted to enter into commercial association with local lawyers or law firms.
Other regulatory issues
In this jurisdiction:
- There are no specific rules in relation to advertising by lawyers or law firms.
- There are no specific rules relating to use of names by lawyers or law firms, apart from compliance with the general Peruvian legislation on Marks.
